Welcome to Dwellir AB ("Dwellir," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our API services that provide access to various blockchain networks (the "Services"). By using our Services, you agree to these Terms. If you do not agree to these Terms, please do not use our Services.
To use our Services, you must be at least 18 years old and have the legal capacity to enter into binding agreements. By using our Services, you represent that you meet these requirements.
To access certain features of our Services, you may be required to create an account. You agree to provide accurate and complete information during the registration process and to update it as necessary. You are responsible for maintaining the confidentiality of your account information and are liable for all activities that occur under your account.
You agree to use our Services only for lawful purposes and in accordance with these Terms. You shall not use our Services to:
Each individual or entity may maintain only one account. Creating multiple accounts to bypass usage limits, avoid fees, or circumvent any restrictions is strictly prohibited. An individual may have both a personal account and be associated with organizational accounts.
Enforcement: We may suspend or terminate all related accounts involved in multiple-account abuse without prior notice. We reserve the right to retain any fees paid by accounts engaged in such abuse if they accessed any services, regardless of the value of services used.
Access to our Services may require payment of fees. Our pricing information is available on our website and may change from time to time. Payment is due at the time specified in your agreement with us. Failure to make timely payments may result in suspension or termination of your access to the Services.
If your usage exceeds the included usage or plan-specific overage threshold for your subscription, we may invoice and charge applicable overage fees during the then-current billing cycle instead of waiting until the next scheduled renewal invoice.
Certain features of the Services are offered as paid add-ons (for example, premium endpoints). Where a trial period is provided for a paid add-on, the applicable fees are waived only for the duration of that trial. If you continue to use a paid add-on after the trial period has expired, or if you use a paid add-on without having activated a trial in the first place, you agree that we may charge the associated add-on fee retroactively from the date the trial expired or usage began. Continued use of any paid add-on constitutes acceptance of its associated fees as published on our website.
We comply with the General Data Protection Regulation (GDPR) and other applicable EU laws regarding data protection and privacy. By using our Services, you consent to our collection, use, and sharing of your information as described in the Privacy Policy.
Dwellir and its licensors retain all rights in the infrastructure, software, documentation, trademarks, branding, API keys and credentials, and other proprietary technology used to provide the Services. Except for the permissions expressly granted below, no ownership of those materials is transferred to you. Nothing in these Terms assigns ownership of underlying blockchain data to Dwellir or to you.
For purposes of these Terms, "Service Data" means data contained in responses returned by the Services. Service Data does not include Dwellir's infrastructure, software, documentation, trademarks, branding, API keys, credentials, or other proprietary technology. "Derived Products" means datasets, analytics, applications, reports, signals, or other products or services created using Service Data.
You may access, retrieve, copy, reproduce, cache, store, aggregate, analyze, modify, transform, enrich, combine, display, distribute, license, sell, and otherwise commercially use Service Data and Derived Products, including in raw or transformed form. You may also resell or provide access to the Services, including on a white-label basis, through infrastructure, products, platforms, proxies, or endpoints controlled by you.
Except for your authorized personnel and contractors acting on your behalf who need them to operate your service and are bound by confidentiality obligations, you may not disclose or transfer Dwellir-issued API keys or credentials to customers or other third parties. You remain responsible for your customers' access and usage, all usage attributable to your account, payment of all applicable fees and compliance with all applicable plan limits, and preventing use that violates applicable law or these Terms.
These permissions apply to the extent Dwellir owns or controls the relevant rights and do not override third-party rights that may apply to underlying blockchain data. When your access to the Services ends, you must cease accessing and reselling the live Services. You may continue to retain, use, distribute, license, sell, and otherwise commercialize Service Data lawfully retrieved before termination and any Derived Products created from it.
We reserve the right to terminate or suspend your access to our Services, at our sole discretion and without prior notice, for any violation of these Terms or applicable law, including Multiple-Account Abuse (see “Prohibited Conduct — Multiple-Account Abuse” above). You may also terminate your account at any time by notifying us in writing.
To the fullest extent permitted by law, Dwellir shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use or inability to use our Services, even if we have been advised of the possibility of such damages.
You agree to indemnify and hold Dwellir harmless from any claims, damages, losses, or expenses (including attorney's fees) arising from your use of the Services, your violation of these Terms, or your infringement of any rights of others.
These Terms shall be governed by and construed in accordance with the laws of Sweden and the European Union. Any dispute, controversy or claim arising out of or in connection with this contract, or the breach, termination or invalidity thereof, shall be finally settled by arbitration in accordance with the Rules for Expedited Arbitrations of the Arbitration Institute of the Stockholm Chamber of Commerce.
We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on our website. Your continued use of our Services after such changes constitutes your acceptance of the updated Terms.
